CONDIZIONI GENERALI PER L’UTILIZZO DEL PARCHEGGIO NON CUSTODITO A PAGAMENTO “GP MONZA PARKING” Via Madonna delle Nevi – Biassono MB
Con l’immissione della vettura/camper nell’area di parcheggio viene a perfezionarsi fra le parti (Gestore-Cliente) un rapporto avente ad oggetto la sola occupazione di un posto auto o camper alle condizioni qui infra riportate. Detto rapporto non ha per oggetto né il deposito né la custodia del veicolo ed è quindi espressamente esclusa ogni responsabilità e/o risarcimento, da parte del gestore, per eventuali furti e/o danni, anche parziali, cagionati a terzi, sia alle persone che ai veicoli, sia che questi siano in sosta o in transito.
E’ possibile la presenza in loco di personale di servizio del Gestore, senza che ciò comporti in alcun modo l’assunzione da parte di quest’ultimo di obbligazioni di custodia, impegni e/o responsabilità di sorta. Con il ritiro dell’autovettura/camper e l’uscita della stessa dall’area di parcheggio, si intende concluso il rapporto.
L’orario di pagamento del parcheggio è il seguente: giorni feriali dalle 7.00 alle 21.00 , giorni festivi e prefestivi 6.30 – 21.00. L’orario potrà essere modificato per disposizione del gestore.
Ai soli Camper è consentita la sosta fino alle ore 07.30 del giorno successivo. Trattandosi di servizio di parcheggio e non di campeggio, a tutti gli utenti è vietato il montaggio di tende, tendoni, tendalini e di qualsiasi attrezzatura da campeggio.
Di conseguenza è vietata l’occupazione di spazio esteso oltre il normale stallo di sosta.
E’ obbligo del conducente lasciare la propria vettura all’interno degli spazi delimitati, con motore spento, perfettamente frenata e chiusa, ed inoltre adottare ogni cautela per la sicurezza.
E’vietato tenere il motore acceso oltre il tempo strettamente indispensabile al parcheggio dello stesso.
La sosta è vietata al di fuori degli spazi appositamente delimitati, negli spazi riservati ai portatori di handicap e nelle aree temporaneamente riservate per disposizione del gestore.
Le autovetture parcheggiate in modo da costituire intralcio per la circolazione o pericolo potranno essere rimosse su disposizione degli agenti di Polizia Locale. La restituzione del veicolo rimosso è regolata dalle disposizioni emesse dal Comune.
All’interno del parcheggio il cliente deve rispettare inderogabilmente le norme del Codice della Strada, la segnaletica predisposta ed allestita dal Gestore, le indicazioni che si presentano per iscritto mediante cartelli oppure fornite verbalmente dagli operatori. La mancata osservanza delle suddette prescrizioni concorrerà ad attribuire al cliente inadempiente l’esclusiva responsabilità personale in relazione ad eventuali danni provocati al proprio od altrui veicolo, persone e/o cose.
Il cliente è responsabile dei danni da lui causati agli impianti, al personale del parcheggio e/o a terzi. In caso di incidente, il cliente dovrà darne comunicazione immediata al personale di presidio e dovrà inoltrare tale comunicazione al Gestore, il cui indirizzo è specificato in calce. In caso di danni dovuti ad urto, collisioni, incidenti, investimenti provocati dai clienti all’interno del parcheggio, il diritto al risarcimento del danno sarà esercitato dal danneggiato nei diretti confronti di chi lo ha causato. Fermo restando quanto sopra, qualsiasi danno al veicolo, ovvero al furto dello stesso, eventuali furti o sottrazioni di accessori, parti di ricambio o singole parti del veicolo comunque verificatesi all’interno del parcheggio, devono essere segnalati tempestivamente come sopra specificato e comunque prima della rimozione del veicolo in sosta, ai soli fini di una corretta gestione del parcheggio e del rilievo degli eventi avvenuti nello stesso.
Il Gestore declina ogni responsabilità per oggetti o bagagli lasciati nei veicoli o all’esterno degli stessi.
E’ vietato lasciare nei veicoli parcheggiati animali, materiale infiammabile e/o esplosivo, oggetti pericolosi od oggetti la cui presenza possa costituire invito al furto.
Il Gestore è esonerato da qualsiasi responsabilità e/o risarcimento nell’ipotesi che per esigenze di pubblico interesse, di pubblica sicurezza, di forza maggiore il servizio debba essere sospeso.
Il corrispettivo dovuto in relazione alla durata della sosta deve essere pagato alla cassa in fase di accesso al parcheggio.
Ai clienti che in fase di uscita non risulteranno in regola con il pagamento, verrà applicata la tariffa massima calcolabile.
Con l’accesso e conseguente sosta dell’auto nel parcheggio, il cliente prende conoscenza delle clausole qui sopra indicate e delle tariffe esposte, che accetta integralmente senza eccezione alcuna. In caso contrario, il cliente è tenuto a raggiungere immediatamente l’uscita, senza l’obbligo di corrispondere alcuna tariffa.

GENERAL CONDITIONS FOR THE USE OF THE UNGUARDED PAID PARKING “GP MONZA PARKING” Via Madonna delle Nevi – Biassono MB
By entering the vehicle/camper/bus into the parking area, an agreement is perfected between the parties (Operator-Client) regarding the sole occupation of a parking space under the conditions listed below. This agreement does not involve the deposit or custody of the vehicle, and therefore any responsibility and/or compensation by the operator is expressly excluded for any theft and/or damage, even partial, caused to third parties, both to persons and vehicles, whether they are parked or in transit.
It is possible for the Operator’s service personnel to be present on-site, without this implying any assumption by the latter of custody obligations, commitments, and/or responsibilities of any kind. With the collection of the car/camper/bus and its exit from the parking area, the relationship is considered concluded.
The parking payment hours are as follows: weekdays from 7:00 am to 9:00 pm, holidays and pre-holidays from 6:30 am to 9:00 pm. The schedule may be modified at the discretion of the operator. Campers are allowed to stay until 7:30 am the following day. Since it is a parking service and not camping, all users are prohibited from setting up tents, awnings, canopies, and any camping equipment. Consequently, occupying space beyond the normal parking stall is prohibited.
The driver is obliged to leave the vehicle within the marked spaces, with the engine off, perfectly braked, and closed, and to take all precautions for safety. It is prohibited to keep the engine running beyond the time strictly necessary for parking.
Parking is prohibited outside the specially designated spaces, in spaces reserved for the disabled, and in areas temporarily reserved by the operator. Vehicles parked in a way that obstructs traffic or poses a danger may be removed by order of Local Police officers. The return of the removed vehicle is regulated by the provisions issued by the Municipality.
Inside the parking lot, the client must strictly comply with the Road Code rules, the signage prepared and set up by the Operator, and the indications provided in writing through signs or verbally by the operators. Failure to comply with these prescriptions will result in the exclusive personal responsibility of the non-compliant client for any damage caused to their or others’ vehicles, people, and/or things.
The client is responsible for the damage they cause to the facilities, parking personnel, and/or third parties. In the event of an accident, the client must immediately notify the on-site personnel and forward this notification to the Operator, whose address is specified at the bottom. In the case of damage due to collision, accidents, or investments caused by clients within the parking lot, the right to compensation will be exercised by the injured party directly against the person who caused it. Regardless of the above, any damage to the vehicle, theft of the same, or theft or removal of accessories, spare parts, or individual parts of the vehicle occurring within the parking lot must be reported promptly as specified above and in any case before the removal of the parked vehicle, solely for the correct management of the parking lot and the recording of events that occurred within it.
The Operator disclaims any responsibility for objects or luggage left in or outside the vehicles.
It is prohibited to leave animals, flammable and/or explosive material, dangerous objects, or objects whose presence may invite theft in parked vehicles.
The Operator is exempt from any responsibility and/or compensation in the event that the service must be suspended for reasons of public interest, public safety, or force majeure.
The fee due concerning the duration of the stay must be paid at the checkout upon entering the parking lot.
Clients who are not in compliance with the payment upon exit will be charged the maximum calculable rate.
By accessing and subsequently parking the car in the parking lot, the client acknowledges and fully accepts the above-mentioned clauses and the displayed rates without any exception. Otherwise, the client must immediately reach the exit without being required to pay any fee.
